Please read these terms before using a KCW product. By creating an account, purchasing a product, or using a service, you agree to these terms. If you use a product for a company, you represent that you can bind that company.
1. Provider and eligibility
The services are provided by KCW Intelligence Labs LLC (“KCW,” “we,” “us,” or “our”), an Idaho limited liability company. You must be legally able to enter a binding agreement. The services are not directed to children under 13.
2. License and accounts
KCW grants you a limited, revocable, nonexclusive, nontransferable license to install and use our applications for lawful personal or internal business purposes, subject to these terms and product-specific terms. You are responsible for accurate account information, authorized devices, and activity under your credentials. Notify support promptly if you believe an account is compromised.
3. Acceptable use
You may not:
- Resell service access or share credentials outside authorized account and device limits.
- Bypass credits, rate limits, access controls, or other service protections.
- Probe, disrupt, overload, introduce malware into, or interfere with the service.
- Reverse engineer protected hosted-service logic except where applicable law expressly permits it.
- Use the service or its output to violate law, privacy, intellectual property, marketplace rules, or another person’s rights.
- Submit content you do not have the right to process or unnecessary sensitive information.
- Misrepresent an estimate or AI-generated result as guaranteed, authenticated, or professionally certified.
4. Your content and feedback
You retain rights in content you lawfully submit. You grant KCW and its service providers the limited rights needed to process that content to provide, secure, support, and improve the service as described in the Privacy Policy. You are responsible for selecting an appropriate screen area and avoiding private chat, financial information, or unrelated personal data.
You may provide feedback voluntarily. KCW may use feedback to improve and market its products without compensation or restriction, but this does not transfer ownership of your pre-existing intellectual property.
5. Plans, subscriptions, and credits
Prices, billing frequency, included credits, renewal terms, and taxes are disclosed before purchase. Subscriptions renew until canceled as shown at checkout. Monthly included credits reset at the end of each usage period and do not roll over. Purchased credit packs are tracked separately and do not expire while the applicable service and account remain available, unless different terms are disclosed before purchase.
A user-started AI operation may consume a credit after processing begins even when it uses multiple internal calls, produces an uncertain result, or returns no valuation. Viewing local history or a cached result does not consume another credit unless the app clearly starts a new operation. See the Refund and Cancellation Policy.
6. AI, valuation, and purchase disclaimer
KCW products provide estimates and information for reference. They do not authenticate an item, guarantee condition or grade, guarantee a current or future sale price, place bids, execute purchases, or provide financial, legal, tax, or investment advice.
AI output, image recognition, marketplace data, population information, grading labels, price guides, exchange rates, listing descriptions, and reported sales can be incomplete, stale, fraudulent, or incorrectly matched. An estimate, range, trend, comp value, or maximum purchase price may omit fees, taxes, shipping, buyer premiums, liquidity, condition, authenticity, regional demand, or later market changes.
You must independently confirm identity, edition, variation, language, grader, grade designation, source evidence, seller, physical condition, authenticity, and transaction terms. You are responsible for all bids, purchases, sales, taxes, marketplace compliance, and losses.
7. Third-party services
Products may use or link to AI providers, cloud hosts, identity providers, payment processors, marketplaces, grading companies, auction platforms, and price guides. Their services and content are governed by their own terms. KCW does not control or endorse third-party listings and cannot guarantee that a reported transaction completed at the displayed amount.
Third-party names and marks belong to their owners. Unless expressly stated, KCW and its products are not affiliated with or endorsed by Pokémon, Nintendo, Creatures, Game Freak, eBay, Whatnot, PSA, CGC, Beckett, or other referenced brands.
8. KCW ownership
KCW and its licensors own the applications, website, visual design, documentation, service logic, and related intellectual property, excluding your content and third-party materials. No rights are granted except those expressly stated.
9. Availability and changes
We may update, limit, suspend, or discontinue features or services. Beta features may be incomplete and may change without notice. We may restrict an account to protect users, data, third parties, or the service. We will provide legally required notice of material changes to paid services.
10. Disclaimers
To the maximum extent permitted by law, the services are provided “as is” and “as available.” KCW disclaims warranties of accuracy, uninterrupted availability, merchantability, fitness for a particular purpose, title, and noninfringement. Applicable consumer rights that cannot legally be waived remain in effect.
11. Limitation of liability
To the maximum extent permitted by law, KCW will not be liable for indirect, incidental, special, exemplary, consequential, or lost-profit damages, or for purchases, bids, resale results, grading outcomes, marketplace disputes, data loss, or reliance on an estimate. KCW’s aggregate direct liability arising from a service will not exceed the amount you paid KCW or its merchant of record for that service during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Termination
You may stop using the services, cancel a subscription, and request account closure. We may suspend or terminate access for material breach, fraud, abuse, legal requirements, or security risk. Sections that by their nature should survive—including ownership, disclaimers, liability, payment obligations, and dispute terms—remain in effect.
13. Governing law
These terms are governed by Idaho law, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. State and federal courts located in Idaho will have jurisdiction over disputes, unless applicable law requires another forum.
14. Changes and general terms
We may update these terms prospectively. The posted effective date identifies the current version, and additional notice will be provided when required. If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. You may not assign these terms without our consent; KCW may assign them in connection with a merger, financing, reorganization, or sale.
